General Terms and Conditions for Reserve-Japan

1. Acceptance of Terms

These General Terms and Conditions (AGB) („Terms“) govern the use of the services provided by Reserve-Japan through the website https://reserve-japan.com. By using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

2. Payment Processing

We work with Shopify Pay and PayPal as payment processors. When using our services, you agree to share your payment information with these payment processors. Please review their respective terms and privacy policies for more information. Customer also provide explicit authorization to let Reserve-JAPAN manage his/her application data and apply on his/her behalf to the Reservation system according to our privacy policy. 

You acknowledge and agree that we may share your contact details with our payment processors for the purpose of processing payments and providing customer support.

Customer certifies he/her is entitled and legally authorized to pay with the submitted credit or debit card. Reserve-JAPAN.COM will charge the submitted credit card one total fee and shall be not liable for any illegal use of credit information submitted by the customer.

3. Changes

Reserve-Japan reserves the right to modify or update these Terms at any time. We will notify users of any material changes to the Terms through the Website. It is your responsibility to review these Terms regularly. By using our services, you agree to the terms and conditions outlined in this document. If you do not agree with these terms, please refrain from using our services. These Terms are subject to change, and it is your responsibility to stay informed about any updates.

4. Accuracy and Site Content

We use reasonable skill and care in compiling the information accessible on and through this site. However, certain information may have been compiled and/or provided to us by a third party who is not a member of our network. RESERVE-JAPAN.COM does not accept responsibility for the accuracy of any information which is obtained from any such third party. Furthermore, errors and omissions in the information accessible on and through this site may occur because of a number of factors which are inherent in any internet-related system and which are not within our reasonable control. For example, information may be affected by machine, software or operator error, or malfunctions in connection with data transmission. In view of this, the information is provided “as is” and you should always attempt to verify the accuracy of any information obtained from this site before relying upon it. This is a dynamic site and as a result, the content and look and feel may change from time to time without prior notice.

5. Security

We reserve the right from time to time to: (a) alter and/or introduce new and/or additional security measures without notice; (b) temporarily withdraw and/or limit the availability of this site to any individual(s); and (c) do anything else that we believe necessary to preserve the security and integrity of this site and the information held in this site’s databases.

6. Disclaimer

(a) Except as may be set out in these terms of use, this site, its content, and any use you choose to make of it, are provided and permitted without any representations or warranties of any kind, whether express or implied, and we disclaim all such representations and warranties so far as permitted by law. We do not warrant that information contained on or accessed through this site is adequate, complete, accurate or up-to-date, nor do we warrant that the site (or any part of it) will always be accessible, fully functional or free from errors and viruses. Accordingly, you agree that the only remedy available to you for breach of these terms of use shall be for our breach of contract under these terms of use.
(b) Subject to paragraph (c) below, but otherwise so far as permitted by law, we exclude and are not liable for all loss, damage(s) and liability (whether or not caused by our negligence) for all wasted time, all loss/corruption of data, all loss of profits, opportunities, and goodwill, and all indirect, consequential and punitive loss or damage(s) arising from or in relation to use of this site and/or the information on it or any services provided through it, howsoever arising, whether in contract, tort (including negligence), statute or otherwise, and even if it was reasonably foreseeable or we have been made aware of the possibility of such loss/damage(s)/liability.
(c) Nothing in these terms of use shall limit our liability for: 
(i) loss or damage for death or personal injury caused by our negligence; or 
(ii) for any fraudulent misrepresentation made by us or those under our control.
(d) If you are using this site as a consumer then nothing in these terms of use shall in any way limit your statutory rights.
(e) We may alter, adapt or otherwise change these terms of use from time to time (for security, legal or regulatory reasons, or to reflect updates or changes to the services or functionality of the site) without prior notice. Your continued use of this site will constitute acceptance of those amended terms of use and you should review them before making any further use of this site.

7. Severability

If one or more of the provisions of these terms of use are at any time found to be invalid by a court, tribunal or other forum of competent jurisdiction, or otherwise rendered unenforceable, that decision shall not invalidate or void the remainder of these terms of use. These terms of use shall be deemed amended by modifying or severing such provisions as necessary to render them valid, legal and enforceable while preserving their intent, or if that is not possible, by substituting another provision that is valid, legal and enforceable which materially gives effect to their intent. Any invalid or unenforceable provision or provisions shall be severable from these terms of use so that the validity or enforceability of their remaining provisions, or the validity of the provision(s) in question in any other jurisdiction shall not be affected.

8. Entire Agreement

These terms of use supersede all prior agreements, arrangements and statements (except for those for which liability is not excluded) between us with respect to your use of this site and constitute the entire agreement between us relating to the same.

9. Data Sharing with Trustoo.io

By using our services, you agree that we may share customer data with our review parnter, Trustoo.io, for the purpose of collecting and displaying reviews. This data sharing is essential for maintaining transparency and ensuring the quality of our services. Rest assured that your information will be handled securely and in accordance with applicable data protection laws from trustoo.io.

10. Authorization for Business Orders

All orders placed by businesses and commercial entities are subject to prior acceptance and authorization by Reserve-Japan. To request authorization, businesses must contact our sales department, where the authorization process, including the completion of an application form and adherence to specific criteria set forth by Reserve-Japan, will be determined. Reserve-Japan reserves the right to review and approve or decline authorization requests at its sole discretion, based on various factors. Orders placed by businesses without prior authorization may be subject to cancellation or other actions determined by our company. These authorization terms and conditions are subject to modification at any time, and businesses will be notified of changes to the authorization process. By placing orders with Reserve-Japan, businesses agree to abide by these terms and conditions.

Cafe Reservation Terms

1. Reservation Process: Reserve-Japan offers reservation services for cafés that are often fully booked within seconds. We will make our best effort to secure a reservation spot at your desired café.

2. Reservation Guarantee: While we strive to secure reservations for our customers, we cannot guarantee the availability of a reservation spot. In the event that we are unable to secure a reservation for you, we will refund 100% of the amount you have paid to us.

3. Reservation Mistakes: The company will process an application to the client’s requirements and requests, and will not be responsible for any incorrect information provided. Customers are responsible for providing accurate information during the reservation process, including but not limited to the correct name and contact details. We are not responsible for any issues that may arise due to inaccuracies in the information provided. The company will make all efforts to obtain the reservation in the specified period of time. Should the company have caused any of the above through error or omission, then the company’s liability is strictly limited to the cost of the reservation fee or refund of all fees paid and the company cannot accept any responsibility for consequential loss, such as, but not limited to: lost profits/income, lost time or other booking fees.

4. Reservation cancellation rights: Once you have submitted your application with us online, it is assumed that you have agreed that we may instantly begin the processing of your application and provide our service, and by agreeing to these terms and conditions, you are therefore providing your express consent for this to happen. As a result, order cancellations are not eligible for a refund. If you choose to cancel your order before your reservation confirmation has been confirmed, you will receive a refund for the fee paid (excluding our service fee according to Art. 402 Abs. 1 OR and Art. 413 Abs. 3 OR). Refunds are issued in the currency paid. Once your reservation confirmation has been confirmed, no refund will be possible. If the café declines your reservation, cannot find your booking in your system or has a technical system failure, no fees will be refunded, as the service is considered rendered and the reservation procedure completed (Art. 413 Abs. 3 OR, Art. 402 Abs. 1 OR). As we are a private company and unaffiliated with government entities, we emphasize that decisions on accepting the entry of the customers are at the sole discretion of the café. We are not responsible for any refusal of access to the café due to their policies, rules, or any other circumstances beyond our control.

5. Delivery Policy: Our Delivery Policy is set out to explain to you, the customer, how we provide the Processing Service offered on our website. RESERVE-JAPAN.COM is a private, third party RESERVATION applications data processing agency and it is not affiliated in any way with the Government of Japan, or the official Websites of these cafés. 
Services provided:
– Reservation: Service to reserve slots for our customers.
– Email customer support on workdays.
RESERVE-JAPAN.COM does not guarantee that reservations will be accepted, we only process the customer’s application data. Therefore, if you are not eligible to get in the reserved slot we can not provide you with anything.

6. Miscellaneous: These terms of use shall not constitute or be deemed to constitute a partnership, joint venture or contract of employment between you and us. You may not assign, new reservation otherwise transfer or deal in any of your rights or obligations under these terms of use without our written consent. Headings in these terms of use are for convenience only and are not to be taken into account when construing these terms of use.

7. Not an Official Partner: We are not an official partner of the cafés for which we secure reservations. We act as an intermediary to provide reservation services. Any disputes, concerns, or issues related to the café’s service or policies should be directed to the café itself, and not to Reserve-Japan.

8. No Ticket Reselling

We do not engage in the reselling of tickets. We only provide a reservation service, and customers pay for the workload an employee needs to complete a reservation of a seat at the café.

Driving License Translation Terms

The following terms are additional for Japanese Driving License Translations, in addition to the aforementioned terms.

1. Liability

The company will process an application to the client’s requirements and requests, and will not be responsible for any incorrect information provided. The company will make all efforts to obtain the correct translation in the specified period of time. However, the company will not be responsible for the following occurring at the Japan Automobile Federation: Refusal to issue the translation, Refusal to accept the application, Issuance of incorrect translation, Delay in processing the translation. The translation is valid for attaching it to an existing driving license from Switzerland, France, Belgium, Germany, Monaco and Taiwan.

Should the company have caused any of the above through error or omission, then the company’s liability is strictly limited to the cost of a replacement of this translation or refund of all fees paid for this translation and the company cannot accept any responsibility for consequential loss, such as, but not limited to: lost profits/income, lost car rental fees, booking fees or fines.

2. Terms and Cancellations Rights

Once you have submitted your application with us online, it is assumed that you have agreed that we may instantly begin the processing of your application and provide our service, and by agreeing to these terms and conditions, you are therefore providing your express consent for this to happen. As a result, order cancellations are not eligible for a refund. If you choose to cancel your order before your documents have been transferred to the Japan Automobile Federation (JAF) you will receive a refund for the translation fee (excluding our service fee according to Art. 402 Abs. 1 OR and Art. 413 Abs. 3 OR). Refunds are issued in the currency paid, based on the current exchange rate of the Japanese yen. Once your documents have been forwarded to the JAF, no refund will be possible. If the JAF declines to process or translate your documents, no fees will be refunded, as the service is considered rendered and the verification procedure completed (Art. 413 Abs. 3 OR, Art. 402 Abs. 1 OR). As we are a private company and unaffiliated with government entities, we emphasize that decisions on accepting the customers’ translations are at the sole discretion of Japan Automobile Federation.

3. Your Consent

By using this site you consent to RESERVE-JAPAN.COM, processing and transferring (both inside and outside the EEA) the User Data as necessary for us to provide you with this service and enable you to use the site and receive your TRANSLATION.

4. Delivery Policy

Our Delivery Policy is set out to explain to you, the customer, how we provide the Processing Service offered on our website. 

(a) Company

RESERVE-JAPAN.com is a private, third party TRANSLATION applications data processing agency and it is not affiliated in any way with the Government of Japan. 

(B) Services provided

  • TRANSLATION: Translation of the driving license application (data entry, processing and sending to the Japan Automobile Federation)
  • Email customer support on workdays.
  • Providing your translation to your home address in Europe or Asia, hotel or private address in Japan or a printing code to print the translation in a 7-Eleven, FamilyMart, Lawson or Ministop shop in Japan.

(C) No Guarantee of Acceptance

RESERVE-JAPAN.com does not guarantee that applications will be accepted, we only process the customer’s application data. Therefore, if you are not eligible to drive we cannot provide you with a translation.

(D) Responsibility of the Customer

The customer is responsible for providing valid and accurate application information, RESERVE-JAPAN.com is not liable for any rejected applications due to non-valid or incorrect information, including not clear photographs of the front and back of your driving license submitted by the customer. Uploading a fake driving license will lead to legal actions against you and not our company. As soon as the customer has submitted his or her information and files, those will and cannot be changed or updated in any way by us except of the case when the client requests any modifications due to an error, but which cannot be guaranteed. If the delivery address will be changed, it is the responsibility of the customer to organize the translation to be sent to the new address. Not clear photographs of the driving license, wrong information of the client, no acceptance or possibility of the delivery of the translation will lead to a extension of the delivery period which is at the expense of the customer and is not Reserve-Japan.com's fault. Then Reserve-Japan.com is no longer obliged to meet the delivery deadline. It is the responsibility of the client to ensure that the provided email address and phone number are accurate and up to date. We are not responsible for any communication sent to an incorrect or outdated contact information.

(E) Delivery Times

Once the application data is submitted, it takes approximately, one to two days from application to delivery for the Seven-Eleven, FamilyMart, Lawson or Ministop express delivery, one week from application to delivery for the Seven-Eleven, FamilyMart, Lawson or Ministop delivery, one to two weeks for the hotel delivery and three to five weeks for the home delivery. No service claims are accepted for non-delivered translation before these weeks after information is submitted by the customer or if the provided e-mail address was not valid or the e-mail provider did block any message sent (i.e. printing code). On national holidays in Japan, the delivery time may be 1-3 days longer.

(F) Fees

The services provided herein are in relation to the submission of TRANSLATION applications. We are not affiliated with Japan Automobile Federation. By purchasing our services, the customer agrees to pay a service fee (Art. 413 Abs. 3 OR) according the prices on the website and an assistance service fee which includes the mandatory fee paid by Reserve-Japan.com on his/her behalf to the Japan Automobile Federation.

(G) Authorization for Application Submission

Customer also provide explicit authorization to let Reserve-JAPAN.com manage his/her application data and apply on his/her behalf to the TRANSLATION system according to our privacy policy.

(H) Payment and Credit Card Information

Customer certifies he/her is entitled and legally authorized to pay with the submitted credit or debit card. Reserve-JAPAN.com will charge the submitted credit card one total fee and shall be not liable for any illegal use of credit information submitted by the customer.

(I) Undeliverable Shipments

In the event that the post office holds your translation, whether due to unsuccessful delivery attempts or any other reason, we are no longer obliged to guarantee our delivery times. It is the responsibility of the client to contact the local post office to resolve the issue and redirect the delivery to another or correct address. Otherwise, the translation will be returned to our facilities in Japan, and any new delivery attempt will be charged additionally. Please note that, in such cases, we are no longer obligated to assure the originally given delivery deadline.

5. Other Requirements Than a Translation

You must consult the relevant Japan Automobile Federation for other requirements than a translation to drive in Japan. Requirements are subject to change and it is advisable to check for updates in good time before departure. We regret we can accept no liability if you are refused driving in Japan or cannot rent a car due to failure on your part to carry the correct driving license, translation or other documents required by any enterprise, authority or country.
The User’s use of the Website and or the Offered Service is on the strict understanding that the Website and or the Offered Service is not engaged in rendering advice and should not be relied upon when making any related travel or other decision. The information contained within the Website and or the Offered Service is provided without warranties expressed or implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website and or the Offered Service. The Company does not guarantee uninterrupted availability of the Website and or the Offered Service nor, that any representation or statement contained on the Website will be error free.

Attraction Ticket & Booking Service Terms

  1. Booking Process:
    Reserve-Japan offers a booking assistance service for attractions that frequently sell out or require advance reservations. We will make our best effort to secure your desired date and time for the chosen attraction.

  2. Booking Guarantee:
    While we strive to secure attraction tickets or reservation slots, we cannot guarantee availability. If we are unable to complete the booking for your selected date/time, we will refund 100% of the amount paid for the ticket price.
    The service fee remains non-refundable (Art. 402 Abs. 1 OR, Art. 413 Abs. 3 OR). For the PokePark attraction, if only 1–2 preferred dates were provided, a 90% refund will be issued in the seldom case the reservation cannot be secured. In the event that Ace Trainer Tickets are unavailable, they may be substituted with standard Trainer Tickets without prior notice.

  3. Booking Mistakes:
    Customers are responsible for providing correct and valid information, including names, travel dates, and contact details. We are not liable for rejected bookings caused by incorrect information provided by the customer.
    If the company makes an error or omission, the liability is strictly limited to the refund of the booking fee and does not include any consequential losses such as lost income, time, transportation costs, or other bookings.

  4. Cancellation Rights:
    By submitting your booking request, you agree that we may immediately begin processing your application. Therefore, cancellations are not eligible for a full refund.
    If you cancel before we book the attraction, you may receive a refund excluding our service fee (Art. 402 Abs. 1 OR, Art. 413 Abs. 3 OR).
    Once tickets or reservations have been confirmed, no refunds are possible.
    If the attraction denies entry due to their rules, policies, or technical issues, no fees will be refunded, as our service is considered rendered.

  5. Delivery Policy:
    Our Delivery Policy explains how we provide our booking service. Reserve-Japan is a private, third-party booking data-processing agency and is not affiliated with Japanese attractions or their official operators.
    Services include:
    – Attraction reservation/booking
    – Customer support on workdays
    We do not guarantee acceptance or entry into the attraction.

  6. Miscellaneous:
    These terms do not establish a partnership, joint venture, or employment relationship. Rights and obligations may not be transferred without our written consent.

  7. Not an Official Partner:
    We are not affiliated with or endorsed by any attraction. All responsibility for the attraction service, quality, rules, and operations lies solely with the attraction provider.

  8. No Ticket Reselling:
    We do not resell tickets. Customers pay for our service fee for workload and booking assistance only.

JR Rail Pass Service Terms

(For booking assistance, NOT issuing the pass)

  1. Application Process:
    Reserve-Japan processes customer information to assist in purchasing the JR Rail Pass from authorized sellers. We make our best effort to complete the application according to the customer’s request.

  2. Availability Guarantee:
    While JR Passes are generally available, we cannot guarantee the acceptance or success of the purchase by the official JR distributor. If the pass cannot be issued, we will refund 100% of the JR Pass value, excluding our service fee (Art. 402 Abs. 1 OR, Art. 413 Abs. 3 OR).

  3. Customer Data Accuracy:
    The customer is responsible for providing correct and valid passport information, nationality, and eligibility (temporary visitor status).
    We are not responsible for rejected applications due to incorrect, incomplete, or invalid data.
    If an error is made by the company, the liability is strictly limited to refunding the processing fee.

  4. Cancellation Rights:
    Once the customer submits the JR Pass application, the service begins immediately, and refunds are limited.
    – Before processing: refund minus service fee
    – After processing or issuing the voucher: no refund possible
    If JR refuses eligibility or entry, no fees will be refunded as our service has been completed (Art. 413 Abs. 3 OR).

  5. Delivery Policy:
    Our Delivery Policy explains how we provide JR Pass processing services. Reserve-Japan is a private third-party processing agency and not affiliated with JR Group or any official Japanese transport authority.
    We only assist in submitting application data. Eligibility decisions are made solely by JR.

  6. Miscellaneous:
    These terms do not constitute partnership or employment. Rights cannot be transferred without written consent.

  7. Not an Official Partner:
    Reserve-Japan is not affiliated with JR Group. All travel rules, restrictions, or acceptance decisions lie solely with JR.

  8. No Ticket Reselling:
    We do not resell JR Passes. Customers pay for our administrative and processing service only.
